IMPORTANT — PLEASE READ CAREFULLY: By accessing or using Dose'd, you confirm that you are at least 21 years of age and legally permitted to access this platform in your jurisdiction. Some products discovered through the platform may be regulated or restricted where you live. YOU ARE SOLELY RESPONSIBLE for determining whether your use of this platform, and any products you discover through it, comply with the laws that apply to you.
Notice: These Terms contain a binding arbitration agreement and class-action waiver (Section 20) that affect your legal rights.
1. Acceptance of Terms
These Terms of Service ("Terms") are a legally binding agreement between you and Dose'D LLC, a Pennsylvania limited liability company ("Dose'd," "Company," "we," "our," or "us"), governing your access to and use of the Dose'd website, mobile applications, and related services (the "Service" or "Platform").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service. We may modify these Terms; material changes will be communicated in-app or by email, and your continued use constitutes acceptance.
2. Nature of the Platform
2.1 A software platform for discovery
Dose'd is a software technology company that operates a digital platform for discovery, reviews, education, and lead generation across functional products — including beverages, supplements, topicals, and hemp-derived and other functional goods. We are NOT:
- a retailer, distributor, or seller of any product;
- a manufacturer or producer of any product;
- a licensed dispensary, pharmacy, or food establishment;
- a party to any transaction between users and sellers; or
- a provider of medical, legal, or other professional advice.
2.2 Discovery and lead-generation model
When you submit an order request through the Service, we transmit your request to the selected seller. The seller contacts you and processes payment through their own systems, and is solely responsible for fulfillment, shipping, customer service, and legal compliance. Dose'd does not process product payments, take possession of product funds, or otherwise participate in the product transaction — every purchase is made directly between you and the seller.
2.3 No endorsement
Listing a product, brand, or piece of content on the Platform is not an endorsement or guarantee by Dose'd. Listings, reviews, and other content are provided for informational purposes only.
3. Eligibility
You must be at least twenty-one (21) years of age to use the Service, and you represent that you meet this requirement. We may verify your age by any lawful means. You further represent that you are legally permitted to access the Platform and any content or products in your jurisdiction, that you understand certain functional products are regulated differently across states and localities, and that you are solely responsible for determining a product's legality in your location.
The Service is intended for use within the United States. Product availability, legality, and shipping vary by location. Providing false information about your age, identity, or location is grounds for immediate, permanent termination and may be reported to authorities.
4. Accounts and Security
To use certain features you must create an account with accurate, current information, keep your credentials confidential, and accept responsibility for all activity under your account. Notify us immediately of any unauthorized access. Each individual may maintain only one personal account; a person may separately hold one or more business/brand accounts (organizations) as permitted by the Platform.
5. Description of Service
The Service includes product discovery and search; three-tier reviews and check-ins; educational content and a compound library; brand hubs and profiles; order requests to sellers (lead generation); social features (follow, post, comment, share); trust & safety tooling (block, mute, report); and business tools for brands and sellers to manage listings, orders, and relationships.
6. User Conduct and Prohibited Activities
You agree to use the Service only for lawful purposes. You will not violate any law; provide false or fraudulent information; impersonate any person or entity; use the Service if under 21 or attempt to obtain products for anyone under 21; or use the Service for any illegal purpose.
You will not post content that is false, defamatory, or fraudulent; infringes intellectual property or privacy/publicity rights; is obscene, hateful, harassing, or promotes violence or discrimination; promotes illegal activity; or contains malware. You will not use bots or scrapers, attempt unauthorized access, interfere with the Service, reverse engineer it, circumvent security, or harvest user data.
7. Review Integrity
To protect the integrity of our reviews, you will not: review products you have not personally used; accept payment, free product, or other incentives in exchange for reviews; post fake, purchased, or artificially inflated reviews; use multiple accounts to manipulate ratings; post reviews intended to harm a competitor; or coordinate to influence ratings.
8. User Content
You retain ownership of the content you submit (reviews, check-ins, posts, photos, comments — "User Content"). By submitting it, you grant Dose'd a worldwide, non-exclusive, royalty-free, sublicensable, transferable, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display that content in connection with operating and promoting the Service.
You represent that you own or have the rights to your User Content, that it does not violate third-party rights, and that reviews reflect your honest, personal experience. We may (but need not) monitor, edit, or remove content at our discretion. Upon account deletion, your content may be anonymized and retained to preserve the integrity of reviews and community content.
9. Consumer Responsibilities
You are solely responsible for verifying that you may lawfully purchase and possess a given product in your jurisdiction, for complying with applicable law, and for ensuring you can legally receive shipments at your address. Product information (descriptions, lab results, effects) is provided by sellers and not verified by Dose'd; conduct your own research and consult a healthcare professional before use, especially if you have health conditions or take medications. When you transact with a seller, the transaction is solely between you and that seller, and any dispute must be resolved directly with them.
10. No Product Warranties
Dose'd makes no representations or warranties regarding any product listed on the Platform. We do not manufacture, sell, distribute, or handle products, and we do not verify product quality, safety, potency, ingredients, lab results, or legal compliance. All product information is provided by sellers and third parties, and your use of any product is at your own risk.
11. Brand and Business Accounts
To operate as a brand or seller on Dose'd, you must be a legally formed business or sole proprietorship with all licenses, permits, and certifications required to make, distribute, and/or sell your products; maintain appropriate insurance; have authority to bind your business to these Terms; and provide accurate business information. We may require documentation to verify your business, and you must maintain eligibility throughout your use of the Platform — loss of a required license, permit, or insurance may result in suspension or termination.
12. Brand Responsibilities
As a brand or seller you are solely responsible for complying with all applicable law; maintaining required licenses and permits; ensuring products comply with applicable requirements (for hemp-derived products, the 2018 Farm Bill and no more than 0.3% Delta-9 THC by dry weight); providing accurate product information, labeling, and lab results; and collecting and remitting applicable taxes.
12.1 Age verification
You are solely responsible for verifying that every customer is at least 21 years of age before completing a sale, requiring valid government-issued identification, and maintaining records as required by law.
12.2 Fair shipping
Shipping charges must reasonably reflect actual carrier, packaging, and handling costs. Setting artificially low product prices while charging disproportionate shipping to avoid platform fees or deceive customers is a material breach. You must communicate shipping policies clearly, resolve lost/damaged/incorrect-shipment issues in good faith, and respond to shipping inquiries promptly.
12.3 Customer data — order fulfillment only
Customer information shared with you (name, shipping address, phone, order details) may be used ONLY to fulfill and communicate about that specific order and to meet legal obligations. You may not add customers to marketing lists, send solicitations, sell or transfer their data, build your own customer database from it, or use it to solicit off-platform purchases. Protect it with reasonable security and delete it when no longer needed. Misuse is grounds for immediate termination, forfeiture of pending amounts, and legal action.
13. Prohibited Brand Conduct
Brands and sellers may not: sell to anyone under 21; sell non-compliant or controlled-substance products; make false or unsubstantiated claims (including health claims); manipulate reviews or metrics; offer incentives for reviews; create fake accounts or reviews; commit fraud or fail to deliver paid orders; or operate without required licenses.
13.1 No review solicitation or incentives
You may not offer any compensation, discount, free product, or other benefit in exchange for reviews or ratings; include package inserts, cards, or QR codes soliciting reviews for a benefit; condition discounts on leaving a review; use review-manipulation services; coach specific review language; or selectively solicit only likely-positive reviewers. You may thank customers and include product-usage information, provided it does not request reviews or offer incentives.
13.2 No off-platform diversion
You may not use Dose'd-facilitated transactions or customer relationships to divert business off-platform — including inserts advertising off-platform purchase, off-platform-exclusive offers, contact collection for marketing, or promotion of competing platforms. Standard branded packaging and general product/brand literature are permitted, provided they do not include calls-to-action, promo codes, or off-platform-exclusive offers.
14. Platform Fees
Dose'd is never the seller of record and never takes possession of product funds. Consumers pay sellers directly through the seller's own payment processor. Dose'd's compensation is a platform fee that is invoiced to the seller SEPARATELY from the product transaction — we never deduct from, hold, or route product payments.
Consumer-discovery (B2C) fee: fifteen percent (15%) of the product subtotal (excluding shipping and taxes), which a seller's subscription tier may reduce. All fees are set by the then-current published fee schedule, read at the time of each transaction, and may change with 30 days' notice. Subscription plans may include tool bundles and fee adjustments per the then-current plan.
Anti-circumvention: directing customers who discovered your business through Dose'd to transact off-platform in order to avoid fees is a material breach. Any sale to a customer who discovered your business through Dose'd within twelve (12) months remains subject to the platform fee, regardless of where the transaction ultimately occurs. We may audit sales records to verify fee compliance. Unpaid fees are a debt owed to Dose'D LLC, accruing interest at 1.5% per month (or the maximum lawful rate, if lower), plus collection costs and reasonable attorneys' fees, with venue in Pennsylvania.
15. Account Standing and Termination (Brands)
We monitor accounts for compliance and may issue warnings, require corrective action, suspend or remove listings or content, or terminate accounts. Repeated failure to fulfill orders, fraud or scam reports, sale of illegal or non-compliant products, loss of required licenses, or systematic review manipulation may result in immediate termination. On termination, listings are removed, outstanding fees remain due, you must fulfill pending orders, and subscription fees are non-refundable.
16. Intellectual Property
The Dose'd name, logos, marks, interfaces, and content (excluding User Content and seller product information) are the exclusive property of Dose'D LLC and its licensors. You may not copy, distribute, create derivative works from, frame, or commercially use them without our written consent. All data, analytics, rankings, and aggregations generated through the Service are our exclusive property.
DMCA: if you believe content infringes your copyright, send a notice with the required elements (identification of the work and infringing material, your contact information, a good-faith statement, a statement under penalty of perjury, and your signature) to legal@dose-d.com.
17. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, DOSE'D DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted or error-free, that content (including product information, lab results, reviews, and education) is accurate or complete, or that products will meet your expectations. Dose'd does not provide medical advice — all information is for educational purposes only; consult a qualified professional before using any product, especially if pregnant or nursing, taking medications, or managing a health condition. Dose'd does not provide legal advice, and the legal status of certain functional products varies by jurisdiction and changes over time.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOSE'D AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, GOODWILL, OR DATA, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY PRODUCT OBTAINED THROUGH IT. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DOSE'D IN THE PRIOR TWELVE (12) MONTHS OR ONE HUNDRED DOLLARS ($100).
19. Indemnification
You agree to indemnify and hold harmless Dose'd, its affiliates, and their officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or any law or third-party right, your User Content, your use of the Service, any products you sell through the Platform, or any dispute between you and another user.
20. Dispute Resolution and Arbitration
PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR RIGHT TO SUE IN COURT AND TO HAVE A JURY TRIAL.
Informal resolution: before any formal proceeding, you agree to contact legal@dose-d.com and try to resolve the dispute informally for at least thirty (30) days.
Binding arbitration: if we cannot resolve a dispute informally, you and Dose'd agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Pennsylvania — except that either party may bring an individual small-claims action or seek injunctive relief for intellectual-property infringement.
Class-action and jury waiver: you and Dose'd may bring claims only in an individual capacity, not as a plaintiff or class member in any class or representative proceeding, and both waive any right to a court or jury trial. You may opt out of this arbitration agreement by written notice to legal@dose-d.com (subject line "Arbitration Opt-Out") within thirty (30) days of first accepting these Terms.
21. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. For disputes not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Pennsylvania.
22. General Provisions
We may modify, suspend, or discontinue any part of the Service, change fees with notice, and refuse service or terminate accounts at our discretion, including for suspected fraud or legal concerns. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive. We are not liable for delays caused by events beyond our reasonable control. These Terms, with the Privacy Policy and any applicable brand agreements, are the entire agreement between us; if any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver, and you may not assign these Terms without our consent.
